Attendees:

Dennis Burks, President of Baldwin Park HOA called the meeting to order at 7:00 P.M. All homeowners in attendance were welcomed and notified of the sign in sheet, agenda and ballots. The current Board of Directors was introduced. Dennis Burks - President, Dwight Tovey - Vice President, and Ray Plott - Secretary / Treasurer. Mike Madson, owner of MGM was introduced to the homeowners. After a tally of those in attendance and the proxies received, it was determined that there were not enough in attendance to establish a quorum. The meeting was then adjourned.
Under Article III Section 3.04 of the By-laws, which states in part, “If a quorum is not present nor represented at any meeting, the Members entitled to vote thereat shall have the power to reschedule such meeting, and at that meeting, the required quorum may be reduced to ten percent (10%) of the total votes to be cast.” Based of this section, the meeting was immediately rescheduled and business could then be conducted at the reduced quorum level.
The 2009 budget was presented for review by the homeowners. It was noted that the amount budgeted for landscaping had increased by 3% ($1800) to offset the increased cost for fertilizer. It was also noted that while in the 2008 budget the costs for pool cleaning and maintenance were listed as a single line item, in the 2009 budget there are separate line items for servicing the pool and restrooms ($6000), chemicals/supplies ($2800), and pool deck cleaning and maintenance ($1300).
A question was raised about a $95 charge for "City Metered Water" on the 2008 budget report. It was determined that this was a data entry error by MGM. These charges will be added to "Water, Sewer, Trash" under "Community Center Maintenance".
With the correction of the water charge, the budget was approved. Based on this budget and with the current amount in reserves, the annual assessment will remain the same at $400 per homeowner.
The procedure for collecting delinquent homeowner assessments was discussed. It was explained that once it gets to the point where the Association has to send certified letters or file for a small claims court hearing, there are additional charges to the Association that must be passed on to the homeowner. With the current economic situation, homeowners who are having financial problems were encouraged to contact MGM and the Board to work out a payment plan rather than just ignoring the assessment statements.
It was noted that there are several homes in the neighborhood that are either in foreclosure or in bankruptcy and are currently unoccupied with the landscaping not being maintained. Under article II, Section 10 "Landscaping", the CC&Rs state The Association will have the right to maintain the yard and landscaping if it is not maintained. Costs incurred by the Association in connection with such maintenance will become a Limited Assessment. It was decided that a committee of homeowners will be formed to take on this maintenance after the current property owner is notified.
It was also decided that a committee of homeowners will be formed to review the CC&Rs for possible changes concerning a number of issues, including increasing the number of Board members, requirements on removal of holiday decorations after the holiday, and parking.
President Burks then opened the floor for nominations for the Board. No new nominations where received, leaving only the three prospective board members who had previously submitted their candidacy. With only three candidates for the three Board seats, a motion was made to unanimously approve all three candidates. The motion carried with no objections.
The Board for 2009 will consist of Dennis Burks, Richard Kelly, and Dwight Tovey. The new Board members also appointed officer positions as follows:
- President: Dennis Burks
- Vice President: Dwight Tovey
- Secretary/Treasurer: Richard Kelly
