The meeting was called to order at 1:00 pm.

The minutes from the February 18, 2009, Board Meeting were read and a motion to accept was made and seconded that the minutes be accepted and approved.

The first area that was discussed was the issue of Open Invoices as of March 16, 2009. The following information was provided:

  • There are 28 home owners that are still outstanding on Association Fees ($12,139).
  • There are 15 home owners that have an approved Payment Plan.($5,400).
  • There are 8 home owners that have made partial payments. ($1,798).
  • There are 13 homes that are in Foreclosure, Bankruptcy or are in default and are currently in court proceedings. ($12,899).

MGM has been instructed to continue with current policy and procedures already in place.

Went over the ‘To Do List’ of outstanding issues:

  • Have MGM check to see if they have the revised By-Laws that were approved during the 2007 Annual Home Owners Meeting. MGM did not have a current copy of the By-Laws on file. The Board will forward a copy to MGM.
  • Dennis to work with MGM to come up with adding additional information with the March 1st billing that there is possible future legal action to be taken if there is no response from the home owner or an approved payment plan in place and current. This was completed and information was provided on the March billing.

New ‘To Do List’ issues:

  • Pool Committee to be invited to the next Board Meeting on April 15, 2009.
  • Dwight Tovey to check to see if we have all various copies of the CC&Rs and send them to the ACC Committee. Some CC&Rs varied based on construction phases.
  • Dennis again to work with MGM to come up with adding additional information for the April 1st billing. There will be two different types of information notices provided. One for those that have outstanding balances for the total Association Fees (and have not contacted the Board and/or MGM) and those that have made a partial payment (and do not have an approved Payment Plan on file). This is to inform the home owner that there is possible future legal action to be taken if there is no response from the home owner or an approved payment plan in place. The legal and court fees could run into the hundreds of dollars which are recoverable from the home owners.

The tentative date for irrigation water is April 13th.

MGM asked to send out a second reminder to home owners regarding outside lights not operating correctly. One demand letter will be sent out regarding this issue.

MGM asked to send out a reminder letter to those home owners that still have Christmas lights and/or decorations up.

There was a discussion in regards to going back to the Key Card entry into the pool area (there is no need to change out the system to accommodate Key Cards). The reasoning presented was to restrict unauthorized entry into the pool (codes were being given out to family and friends that do not live in the subdivision). There would be a cost for purchasing the key cards at approximately $5.50 each. The cost for 150 key cards would be approximately $825.00. There will be a refundable security deposit collected (amount to be determined at the next Board Meeting in April), one card per household. There also will be a replacement cost if the original card is lost.

Next Board Meeting will be held on April 15, 2009, at 1:00 pm in the MGM Management office.
